TERMS & CONDITIONS
1. Scope of Service & Deliverables
- Single-Page Web Application (SPA): We deliver a mobile-optimized digital menu and website that loads directly in any smartphone browser without requiring app downloads or physical installations.
- Layout & Functionality: The Web App is built and customized based on the functional structure and features of the approved live demonstration model.
- Multi-Language Visual Menu: Includes visual dish presentations, high-resolution photo optimization, ingredient descriptions, and automated translations for up to 8 languages.
2. Pricing, Custom Scope & Payment Terms
- Standard Package Investment: €898 (comprising a €849 one-time setup fee + €49 first-year hosting and infrastructure fee). This package covers standard single-location setup, up to 8 foreign languages, and menus containing up to 100 menu items/dishes.
- Custom Scopes & Scope Add-ons: Additional fees will apply for requirements beyond the standard package scope, including but not limited to:
- Menus exceeding 100 individual items/dishes.
- Multi-location restaurant setups or multi-venue management.
- Additional foreign languages beyond the standard 8 included.
- Custom layout features, bespoke design tweaks, or non-standard third-party integrations.
- Final Confirmed Investment: The exact total price, including any agreed-upon scope add-ons or custom adjustments, will be clearly itemized and confirmed in writing via email/invoice prior to startup payment.
- Payment Schedule & Staging Approval Process:
- Startup Payment (50% Deposit + 1st Year Hosting): Payable upon ordering to initiate project development.
- Client Staging & Testing Access: Once the initial build is complete, the client will be provided with private access to a temporary staging link (e.g., clientname.template-websites.com) to review, test, and approve the Web App in action.
- Final Balance & Live Launch: The remaining 50% balance is payable immediately upon client review and final approval of the staging site. The Web App will not be deployed to the client’s official live domain or made publicly accessible until the final balance payment has been received in full.
- Non-Refundable Deposit Policy: Because custom configuration, design, and code setup commence immediately upon payment, the initial startup deposit is non-refundable once development work has started.
3. Hosting Options, Self-Hosting (DIY) & Annual Fees
- Managed Hosting Option (Standard - Recommended): Server hosting, domain management, and SSL security are included for the first 12 months. Starting in year two, an annual hosting fee of €49 applies to maintain live server infrastructure, SSL renewals, and domain ownership under our administration.
- Self-Hosting / External Hosting Option (DIY Setup): If the client prefers to retain their existing web hosting provider and domain registrar rather than utilizing our managed infrastructure, this is fully supported. Under this option:
- The annual €49 hosting fee is waived (starting from year one).
- A one-time €75 External Environment Integration Fee applies to cover technical configuration, manual file deployment, and DNS routing within the client's external control panel.
- The client remains solely responsible for their own third-party hosting bills, server uptime, and external SSL renewals.
- Exclusion of Ongoing Manual Support: Neither the €49/year managed hosting fee nor the €75 DIY setup fee includes ongoing manual content updates, menu modifications, price changes, or design tweaks after launch. Any subsequent service tasks requested after the 7-day review window are billed separately at our standard hourly rate.
4. Intellectual Property, Code Ownership & Script Protection
- Client Content & Data Ownership: Upon full payment of all balance invoices, the client holds full ownership rights to all client-provided text, dish pricing, translations, custom media, and photo assets. The underlying menu content files remain completely unencrypted and accessible.
- Proprietary Core Script Protection (script.js / main.js Protection): The primary application logic, UI design framework, visual transition rendering engines, and interactive core JavaScript files (script.js, main.js, and associated system components) are delivered in compiled, protected, and/or encrypted format. This technical measure protects our proprietary template design system and layout architecture from unauthorized copying, extraction, or commercial redistribution.
- Core Logic Modifications: Any modifications, structural feature additions, or functional adjustments to the protected core JavaScript files must be executed exclusively by Template-Websites.com or through an authorized service agreement.
- Termination & Self-Hosting Transfers: Upon agreement termination or migration to self-hosting, the compiled Web App code bundle will be handed over to the client so the Web App continues to function seamlessly on any standard server. However, the underlying core design framework and source architecture remain the exclusive intellectual property of Template-Websites.com and may not be extracted, reverse-engineered, or resold as a standalone product.
5. Delivery Timelines, Delays & Express Options
- Estimated Standard Delivery: Standard delivery is typically 5–10 business days from the moment we have received all complete materials (finalized menu copy, prices, photos, and domain access) from the client.
- Variable Timelines & Delays (21–30 Days): Timelines are estimates and not fixed guarantees. Delivery may extend to 21–30 days in cases involving high agency workload periods, multiple revision rounds, delayed receipt of client materials, or custom feature requests.
- Peak Seasons & Complex Projects (Up to 45 Days): In extremely rare cases—such as exceptionally complex setup requirements, extended content revisions, or peak seasonal workload volume—delivery can take up to 45 days.
- Guaranteed 5–10 Day Express Fee (Starting at €99): If a client requires a guaranteed launch within 5–10 business days, an express priority fee starting from €99 applies. The exact fee depends on project complexity, overall agency capacity, and how fast complete materials are provided by the client.
- Dual-Stage / Partial Launches (Starting at €99): If a client requests to go live in two separate stages (for example, a "quick text-only launch" first, followed by adding visual dish photos and translation polish later), a staging fee starting from €99 applies to cover the extra deployment overhead.
6. Warranty, Exclusions & Content Review Window
- 6-Month Technical Bug Warranty (Managed Hosting): For clients on our managed hosting, we provide a 6-month warranty covering technical defects or system logic errors directly originating from our original codebase.
- 3-Month Technical Bug Warranty (Self-Hosted / DIY): For self-hosted clients, the warranty period is 3 months due to third-party server environments.
- Strict Warranty Exclusions (Billed at Hourly Rate): The warranty strictly covers system bugs inherent to our provided code. The warranty does NOT cover, and we will bill at our standard hourly rate for troubleshooting:
- Errors, broken functionality, or code corruption caused by client-side or third-party editing/modifications to scripts or files after delivery.
- Server outages, PHP/environment changes, SSL failures, or misconfigurations caused by the client's external hosting provider.
- User-induced errors, accidental deletions, or failure of external third-party services/APIs outside our direct control.
- 7-Day Content Review Window: All menu copy, dish pricing, and translations are considered accepted upon official launch. Any minor text adjustments or translation corrections reported in writing within 7 days of launch will be adjusted free of charge. Requests submitted after this 7-day window will be billed at our standard hourly rate.
7. Website Content Accuracy & Disclaimers
- Pricing & Specifications: While we strive to ensure that all information, service packages, and pricing on Template-Websites.com are accurate, we reserve the right to correct any typographical errors, inaccuracies, or clerical omissions.
- Right to Refuse Orders: In the event that a service package or feature is listed at an incorrect price due to a technical error, we reserve the right to refuse or cancel any orders placed for that service prior to starting work, issuing a full refund of any deposit paid.
- Limitation of Liability: Template-Websites.com is not liable for indirect, incidental, or consequential damages (including lost restaurant revenue or operational downtime) arising from temporary server outages, third-party internet delays, or client delays in delivering menu content.
8. Acceptance of Terms
By completing the initial startup payment or confirming an order via our provided invoices, payment links, or email agreements, the client acknowledges and agrees to all terms and conditions outlined on this page.
